"Foley's Name Likely to Remain on Ballot

"Republican and Democratic election lawyers were poring over Florida election law late Friday and assessing the ramifications for the November ballot in light of Rep. Mark Foley’s (R-Fla.) abrupt resignation from the House," Roll Call reports. "Under state law, Foley’s name must remain on the ballot although Republican party leaders can designate someone who would receive the votes that are cast for Foley."

Rick Hasen: "Given Foley's association with scandal, this surely will work against Republicans: voters who are more likely to have heard about Foley's scandal (and would vote against him) than have heard about the arcane Florida election law allowing votes cast for Foley to be counted for his Republican replacement."
