The answer is that your representative (we live in a republic, after all) has access. The representative is Congress itself. That representative has now turned it over to the FBI. By the way, you don't see Foley arguing he has any right to privacy on any of this stuff, do you? He doesn't. Congress, a.k.a., you and I have access through congress' oversight group. They have now turned it over the FBI. I understand no Subpoenas were required.

Maybe there is a freedom of information right here somewhere, but I don't know..It would have to be down the road a ways.
