The general rule is that if the party seeking equity (an injunction) must do equity. I don't see how Broadcomm can refuse to license patents and then ask for an order telling QCOM it has to give Broadcomm a license. The general rule might not apply because of the law in patents and someone more knowledgeable might be able to answer that. But, I would think the general principle is subsumed in the statutory law.
