My point is, that not yet declared a monopoly under the law, it would seem prudent that Intel be proactive and hold themselves to a higher standard than the law currently held them.

With the legal expertise at their disposal I'd like someone to explain how they could circumvent the advise they were getting from their legal team and plot an alternative path. The only alternative I can see is that, assuming the theories held as fact here are true, their legal team was either completely incompetent or complicit.
