Run up and fallout reminded me of this...have to figure dvax may exercise a tranche of this....

Dynavax Secures Equity Financing Commitment of Up to $30 Million
BERKELEY, Calif., Aug. 31 /PRNewswire-FirstCall/ -- Dynavax Technologies Corporation (Nasdaq: DVAX) announced that the company has secured an equity financing commitment of up to $30 million from Azimuth Opportunity Ltd. Acqua Capital Management is an advisor to Azimuth Opportunity. During the 18-month term of the equity financing commitment, Dynavax may sell registered shares of its newly-issued common stock to Azimuth Opportunity Ltd. at a small, pre-negotiated discount to the market price. Dynavax will determine, at its sole discretion, the timing and amount of any sales of its stock, subject to certain conditions.

Freak show. That's what the writer of the following story called the hubris at HP. But what is worse, the shenanigans at HP or the hubris at DVAX?

How is what occurred at HP any worse than the "arrogance" at DVAX? While it was only insiders who were hurt at HP, all shareholders of DVAX paid the price of favoritisms to the few - to say nothing of employees. So how do shareholders ensure CEO's with a strong sense of ethics get promoted?
