Your advanced BLS blinds you to the reality of a unitary executive with a rubberstamp congress, who can now designate anyone he sees fit to be a "terrorist" and put that person away without due process of law. Hitler had no more power than that. This effectively ends the interplay between the branches and puts every American at risk. And even when congress passes a law the unitary executive simply uses a signing statement to ignore those parts of any legislation that he does not like. The rubberstamp congress stands by slack jawed.
