There are many charges that don't depend on testimony, such as contracts that forbade advertising or any documention of the conditions for marketing rebates.

Those will be clean as a whistle, imo. The theory is that the pressure came from higher up and they wouldn't put something like that in writing. Making them an offer they can't refuse, that sort of thing. All nonsense imo but that seems to be the theory. If Intel put something like that into a contract then shame on them and they deserve whatever they get.
