If *that's* all Gitmo was... then there would be no reason not to have it stateside. For example, we had no difficulties prosecuting German agents captured out-of-uniform in WW II.

We captured a handful of Germans captured out of uniform in the US during WWII. They where prosecuted through military tribunals. Germans captured overseas where not normally prosecuted at all they where thrown in cells or camps for the duration. If they were out of uniform they might have even been shot or hung as spies.

The reason we don't have it stateside is the courts operate differently now than they did then. If we had the courts of WWII there would most likely be little problem in having the facility stateside.
