The judge's involvement in the sentencing depends on the state laws governing this matter as well as the nature of the crime. The incident was serious because it was a felony. However, not all felonies are created equal. This was one of the lesser felonies.

A judge does not overturn an agreement, it is sent to the judge for their consideration, we all know that.

Excuse me. There was a plea agreement between the prosecution and the defense. The judge decided to amend that agreement. Is that better?

I do know that their sentences began in May, I do not know if some are still serving time or not. They may or may not be...

The point was not so much whether they were still serving or not but rather how long were their sentences. I didn't realize that the trial took place nearly a year and half after the crime. The way you originally were discussing the issue......it sounded as if the got really stiff sentences.......2 or more years. However, 4-6 months sounds much more appropriate.

Okay? So now we are done with the Dem's crimes. Where should we start with the GOP's long list? How about Cunningham? Did you hear he wrote the reporter who uncovered his crime a 4 page letter telling him he was a big meanie and complaining that the contractor who gave him kickbacks was "the devil"? Its nice to know that Cunningham was not responsible for any of the crimes of which he's been convicted. Sadly, he's just another decent human being framed unfairly.
