If your directly suing them for the same thing they are convicted of I suppose you could use the conviction. If they where acquitted or not tried than you can't use it so in that sense it would be harder.

I suppose that you could argue that the conviction is evidence even if the conviction was dismissed because they died before the appeal was finished. But I'm not sure, IANAL.
