The writ of habeas corpus in common law countries is an important instrument for the safeguarding of individual freedom against arbitrary state action.

Which is why the US no longer has a need for it.

We gladly trade our freedoms for tax cuts.....

So what is the latin for 'You were supposed to justify having the body until we repealed the Magna Carta, but hey, no worries now mate'?

en.wikipedia.org

' ... Magna Carta required the king to ... accept that the will of the king could be bound by law.'

But there are those who don't believe in such frippery -

It is a sad day when the people in power so enamored by so many posters a couple years ago are fudging on civil rights and more importantly our constitution. Or so it appears. The answer will come from the courts but will take time.

It means 'body of evidence'. In other words to lock up you should have a case. no writ, no right.
