There is no uniter. I can't even envision what a uniter would look like. The fundamental differences between the political philosophies are so stark, the only uniting possible is severe compromise. And compromise is unacceptable to committed factions on both ends.

What we have is a cultural/political war that will probably escalate, rather than be solved.

As for alien, I believe that is a long accepted legal term for people who are not US citizens. I'm not sure any more connotation should be read into it.

But even citizens who trust that this Act is legally confined to particular aliens may rue the deed. Many believe that citizen rights are simply HUMAN rights encoded by statute--as was the rationale behind the Constitution. Therefore, it is still possible to accept the legality of the Act as it relates to citizens, while lamenting the fact that it deprives certain people of fundamental rights.

Is it a fundamental human right to wage war and if captured to be tried in front of a civilian court, with trial by a jury of their peers, with the full appeals systems, the right to confront your accuser, and all the other protections normally afforded in the US court system?

I don't think so.

And I think trying to apply such a concept as a fundamental human right that will be legally protected, will lead to a lot fewer prisoners being taken, instead having them "shot during battle", or "shot while trying to escape".
