Carranza, my gut`s with you on how Rudi is likely to rule on remand. Most trial judges don`t appreciate having to rule again on the same matter, with a new standard created by a 2 to 1 panel, articulating a distinction without a difference. However, even if he decides favorably, the same panel is likely to get an interlocutory appeal, potentially followed by En Banc consideration. Delay, delay, and more delay, ultimately mooted by a new license.

Actually, I'm with BDAZZ in that your discussions on the rulings are extremely informative. A very dear friend of mine, A superior Court D.A., has been encouraging me to go into law...I'm considering it.
