fulcruminquiry.com This is interesting. It concerns a tax decision out of the DC Circuit dealing with whether emotional distress damages in whistleblower or similar cases are actually taxable. The court said no on constitutional grounds. Since approximately 1986, the taxation of emotional distress awards in employment litigation has often been an impediment to resolution. As I recall, this stemmed from an add on to some bill signed by Clinton at the time. I can't recall who stuck in the provision at the last second. I wonder if Smithee has encountered this issue in his...ahem...movie career.<g>
