The devil will be in the details on how the increase the tax to the trusts. They can't just up the withholding on the dividends without impacting tax treaties.

In 4 years the Bush tax cuts expire (I think its 2010 for the dividends back up from 15% to the ordinary rate and 2011 or 12 for the ordinary rate to go back up to 39.5%). The issue will be the rate breakage between the two tax schemes.
