QUALCOMM is not Microsoft. Microsoft was a true monopoly that also engaged in anti-competitive business practices, and for that they got kicked by the Europeans. Despite the efforts of Nokia to make QUALCOMM look like a monopolist, that's hardly the case when QCOM doesn't make any CDMA phones, nor is it the only manufacturer of CDMA/CDMA2000/WCDMA chips. The differences between QCOM and MSFT are only too transparent--even for the Europeans to lump them together.
