That's probably because Cingular has W-CDMA only in some areas with its 360mbs max data speeds or HSDPA in other areas but to the extent they are doing voice and HSDPA data in the same 5MHz channel, priority is given to voice and results in a poor data experience (i.e. long down load time). This is different than EV-DO which uses a dedicated 1.25MHz data channel. Like many of the W-CDMA operators, Cingular will at some point deploy HSDPA in a dedicated 5MHZ "data only" channel and I would expect them to offer over the air down loads at that point.
