"We have never believed that Nokia's patents are applicable to our products. As you probably know, our current rates for Nokia are royalty-free. So there has been never any tacit acknowledgment of their applicability to our products." -- Lou Lupin during F06Q4 Earnings CC

tacit, adj. -- 2.b. Law. Arising by operation of the law rather than through direct expression.

>>What the heck does that mean?

I think Loupin is saying, there is no legal agreement, that acknowledges NOKIA's IPR applicability to our products.

We don't believe we are infringing so prove it.

On the flip side, Nokia has already acknowledged needing our IPR, so this would show will full infringement on their part.

Is this what he should be saying?

They need to pay our rate when the license expires, and then they need to prove we are in fact infringing their IPR. If we are found to infringe, we will then pay the FRANDLY rate.
