That language is not inconsistent with Lupin`s assertion at the conference call, masa. The termination of Qualcomm`s rights to sell chips under Nokia`s patents does not speak to the question of whether or not Qualcomm intersects those patents in their products.

100 x 9.26 / 223 = 4.15 % (= average royalty)
