Yes it might be.

There will probably be hearings of some sort. They can exert some political pressure but can't really stop the program. What could stop the program is a judicial ruling or possibly "zero-funding" it. The later might be complex. It isn't a budget line item, and Republicans could filibuster (or defeat if they get a Democratic defections) a bill that says something like "no funds shall be used to..." about the program. In theory impeachment could also stop the program, but the Dems are unlikely to try, may fail to impeach if they do try, and have very little chance of ever getting a conviction. And the effort would hurt them politically in '08.
