Just in case you could not tell, they are not US citizens....not to mention the fact that they are POW's caught on battlefields around the world.

I thought Gitmo was an American Base, how is it outside the constitution of the US? I didn't think you charged Prisoners of war, but that under the Geneva convention arranged their release to the country they represented. If they don't represent a country, or someone recognised by the Geneva convention, who do you negotiate with? OTOH if they are awaiting trial for WarCrimes or Crimes against Humanity, like the kid who threw a grenade at the medics, and a. was not in uniform, and b. committed a war crime. Why are they still alive?
