Copyrighting, IPR and legalities aside, it's fairly obvious at this point that there is a recent and suddenly growing awareness of the issues surrounding the openness of architectures of both handheld devices and service providers cellular networks, as well. I cite the recent iPhone release from Apple; dual-mode (wifi/cellular) handset availability; the implications of FMC; etc.

Hopefully this groundswell of awareness will serve as a message to the affected industries stating that end users' have new, self-provisioning types of requirements at the user edge, and that it won't just cause so much additional resistance and creative toll-collecting on the part of incumbents in order to maintain their stasis and exerting their pricing powers, respectively.

My gut says tha we will be seeing some yielding of territory in this respect, but only because there are sufficient numbers of them competing with one another with at least one of them, T-Mobile, e.g., with "nothing to lose and everthing to gain" by being the spoiler.
