40 million per year is 0.02% of the federal budget of $200 billion. If Harper spent 0.02% of a year on the issue, he would have enough time for a 20 minute news story (250 days/year, 8 h/d).

I agree the problem is significant, but more for what it means for the land claim resolution process. Justice delayed is justice denied, and our system is far too slow, and is saddled with antiquated and conflicting common law. If the courts could simply put principle above precedent, the problems would have been solved long ago. My solution is not a popular one with lefties or with many natives, who are largely deluded into thinking their aboriginal rights are an asset rather than a liability.

My solution is to give the natives individual common law rights to everything they now have rights to, and to abolish the collective rights that prevent any of them from actually benefiting from their inheritance. The courts would have to decide what those rights are for each individual, which could be an onerous task unless the treaty rights could be monetized or divided (much like common law water rights are). Unfortunately, that would require abrogation of the current treaties and revoking the Indian Act - and that would require very strong leadership and broad support. So, until we can convince the native politicians to give up their self-serving power base to the benefit of their people, we will trudge along with an alienated third world underclass.
