Do you think the stock will just linger in the mid to high 30's?

That will depend on earnings. I think Qualcomm low-balled their guidance again, but we'll have to wait and see if WCDMA regains traction in the 1st half of next year.

I am starting to wonder if the lack of performance by Qcom stock price is due strictly to to the litigation issues. Take a look at MO stock price for the last five years while paying a hefty dividend

The litigation that the Q is going thru is a easy compared to what they have been facing . Management needs to figure out how to increase the share price for shareholders
