From a wide range of people (who have been involved in litigation) that I have talked to, this is a very typical legal tactic. You simply wear down an opponent by draining their financial resources. And in the case of SCOX, IBM is well aware they are not running profitable ... which means that if things drag out they continue to lose money and will eventually go under.

You could do the math fairly easily by looking at their liquid assets, and then their current burn rates ... do the math and you know how long they have before they die. Unless they find investment capital, or revenues from the sales of products.

Worst case they "close the doors" and lay off all employees, and keep a skeleton crew to man the lawsuit ... ;-)
