"there is no evidence after comprehensive investigation to suggest he took anything other than the five documents at issue and they didn't have notes."

Of course there is "no evidence." The "evidence" has been destroyed. Nobody knows what he took except for Sandy.

Couple of things, Alastair: 1) Seems that since Dick Morris knew Berger on a first name, personal basis in the WH and most of us don't have anything like that experience, it would seem that perhaps Morris knows a few things about Berger that we don't.

2) Don't forget....The REAL problem with Berger stealing the papers is just that: He STOLE them, which certainly is against the US Law.

It would be for you, and it is for me. It isn't a "conspiracy" to KNOW that someone broke the Law and got away with it. It is a FACT.

And don't kid yourself.....Berger didn't steal with no reason. There is ABSOLUTELY NO reason he would do such a thing, without a serious reason, at least in his mind. Even he knew he was stealing. And surely he knew he would be seriously compromising his career, and his legacy from his WH days. Tell me why he would do that?

Or do you just think Berger was/is a stupid man who was unaware of his legacy?
