That's the problem all right. But you can clearly spell it out in the law, as you proposed. In addition, you can make exceptions really hard to pass, such as a 75% majority in both houses to override the balanced budget ammendment.

But then again, I think of all these excuses. I mean why doesn't the President say that we need to go to war, so he's going to have to raise taxes or cut in other areas in order to do it? Many people always argue that it's too easy for America to go to war. They complain that the leaders have nothing at stake, like their own children. Well, one way to make it harder and more of a last resort is if they have to find the money from cutting spending elsewhere or raising taxes. Then they'd know for sure the American people were behind it. That's the kind of checks and balances we need for going to war.
