The same situation applies to all state law. The states that might make abortion illegal would obviously be the states where the majority of voters think it should be illegal.

I arrive at the decision I think most fair, and which benefits society.

Fine, but in the current system where the Supreme Court sets the policy your decision has no weight. It doesn't matter what your personal view might be, the electorate doesn't vote on legality of abortion. The Supreme Court has ruled that somewhere in our Constitution there is a guarantee of the right to an abortion. I didn't read that part back in high school, but they say its in there somewhere.
