I'd say he's already doing that with his "signing statements". I think the Dems should get ALL of those classified as illegal, null and void first thing.

But, that will be up to Bush's Supreme court, won't it?

Yeah, after cruel and unusual torture and warrantless wiretapping, if he then moved decisively outside the Constitution, that would be a problem.
