It seems rather threatening to me. Naming someone an "enemy of the state" implies that they should be harmed for simply disagreeing with the policies of the government. Sean Penn's crime is having a different opinion than Sean Insanitiy and his right wing goons.

He in fact can - it is difficult to prove, but not impossible. He's certainly got the money to do it.

It must be hard to determine whether to ignore the moron or go after him. To me, it would be more satisfying to go after him.

I don't think so, it's the same as if I say "Bush is the greatest enemy of humanity who has ever lived," it is clearly an opinion with some hyperbole thrown in.
