No, if Richardson is about to be hired by BRCM, you hire him as a non-testifying consulting expert. He cannot be deposed by BRCM, he doesn't testify at trial, he keeps his opinions to himself, and helps the Q legal team behind the scenes.

That is how you deal with it.

Broadcomm would have gotten their expert to say that Richardson's book is a recognized authority in the field and quoted the sentence anyway. Then, Richardson would not be available to explain. This way he was and was there to testify in Qcom's favor.
