They tried to get it dismissed which means they are still in litigation and have to prove themselves not guilty. A dismissal is not a court battle...

What ever "crippling" there was to the Stiletto, it did not seem to bother the consumer. You did not forget that SIRIUS out sold XM by a wide margin last quarter when the Stiletto was introduced. Let's see....net subs were more than two to one SIRIUS. Gross was in SIRIUS' favor as well. XM needs to follow Mel's lead, but apparently everybody wants a SIRIUS anyway; so it won't do XM any good.
