What's your take on this?

I disagree with it. The President is the Constitutional head of the Executive Branch. I disagree with a great many of his policies and feel he is not representative in virtually any way of the kind of Republicans I grew up admiring, but he is the President. If the congress and the courts won't exercise THEIR obligation to balance the executive branch, I can't fully blame Mr. Bush for that fact.

I do find it interesting that every time lately the courts or congress do push back on some aspect of expanded executive privilege (most recently on warrantless wiretapping), the Executive branch backs off....Flipflopping?

So perhaps the checks and balances are reasserting themselves, albeit somewhat late.
