According to the most knowledgeable person I know of on the subject, recording a broadcast (digital or analog) is clearly within the meaning of "fair use". And these devices do not allow any form of serial copying.

Which, in reality, makes XM's case pretty open & shut. Because a District Court judge doesn't comprehend it, well, that's an annoyance.

I just don't know that the recording capability in these devices is proving to be worth the fight. However, I suspect that XM has every expectation of adding this capability to OEM units in the future, and that may make it worth going through the appeals process and getting it straightened out, I don't know, not being a lawyer.

Are you a lawyer? I know you're an expert on everything else, but I really wasn't sure whether the law was within your expertise or not...
