From the prior post it appears that Lucky Friday is operating only on the leased portion for now. Who knows? I usually do not buy companies in litigation so have stayed away from that one.

None of the documents I've seen put a limit like that on the royalty; however, no royalty is payable until all costs of development are recovered. I believe the outstanding balance is ~$39 million. And those costs are the issue in the law suit now in federal court.
