LOL!! We'll you keep looking for an erroneous post from me, because they don't happen very often. While you on the other hand, make blatantly erroneous posts on a daily basis.

Read the judge's opinion. She made it clear it was not a ruling on the merit of the RIAA's case, and only on whether there is a sufficient case to warrant a trial.

The FCC isn't the only agency involved. DOJ would have to approve it, as well.

Let's see FCC Chairman Martin is mentioned once.
The FCC is mentioned 3 times.
FCC specific terms such as NPRM were used, etc.
