Lupin however stated>>> (Lupin): " ...if they do elect to exercise the extension, it actually extends the agreement for a considerable period of time...and so it can't be used simply to delay the action ." At that time, I interpreted Lupin’s remarks to mean if the option was exercised before 2008 ye, the new agreement would extend “for a considerable period of time” **after** 2008 ye. . It now appears that the “considerable period” Lupin was referring to is the period between April 07 and 2008 ye. So, as you say, NOK could sign in April 07 at the last minute extending the existing terms thru 2008 and continue to pay royalties and avoid the possibility of an injunction. And, as such, the relief could only be temporary with 18 months of continuing royalties, but the agony of another stalemate / deadline still on the horizon (18 months in the future)---“ extend the overhang on QCOM stock through 2008.” That’s a definite possibility, but I wonder if the “overhang” would continue with NOK again “blinking” by signing another extension (at the same terms) and they did in 2001? Perhaps the “market” in it wisdom might catch on to NOK’s bag of tricks after playing the same hand and losing on two separate occasions!!!
