He more likely would use one of his signing statements. That would put the ball squarely in Congress's court.

What can I say? Clearly the Founding Fathers weren't Prussian, else a lot of these things would have been spelled out in excruciating detail.

In the past, we had presidents and a Congress dedicated to making the system work. So the gray areas got resolved quietly. But now we have a president who is dedicated to getting his way and doesn't care about the system. This situation is not going to end in a good way.
