I wouldn't mind if you called my position folly. You could say why and I'd probably disagree. I don't think its rude to say an opinion is folly, especially if you explain why you think that. It seems pretty clear international law as you describe it would produce some pretty horrific results - and I gave real world fairly recent examples (Cambodia, east Pakistan, the Balkans). I think a more rigorous examination of history would uncover more. Therefore, I think its fair to say the logic behind the idea you're pushing is either flawed or is at least a logic which gives little or no value to human life.
