It is illegal, when Y is set differently for each OEM, according to their market share. An obvious attempt to manage market whare of Intel processors. Yes, that is illegal.

They are when discriminatory and secret and the discount applies only when purchase volume reaches the level of 100% of purchases from a company with monopoly power. Note that discriminatory in this context means Company X gets discount X and Company Y gets discount Y.
