Not only they are not commodities, but also the act says that they must be "of like grade and quality". There are so many grades and qualities in the Intel product lineup, so it would be hard to compare deals with all things equal. There could be many other customisations attached to deals like special markings, special tape carriers, pre-applied heat-conductive adhesives, etc.

More, the document talks about prices to "competing resellers". Formally speaking, PC OEMS are not "resellers", they are "OEMs". Therefore, a smart lawyer can find a lot of loopholes in applicability of this act to AMD-Intel issue.
