So what do you do with captured Al Qaeda? Since they arepart of an active army that is trying to kill Americans, you cannot try one without exposing your actions to capture others still at large. Besides, they are not criminals - they aren't doing this for profit, and they don't fall under American legal juridiction. But they sure don't follow the Rules of War either. So what do you do with them?

1. I would provide their identities and list their alleged crimes, or at least the reasons they are being held.

2. I would provide all the proof which lead to the conclusion that they need to be held, the type of proof that would be presented were they to be tried.

Those two at least. After that information was available, I'd have a better ability to assess what to do with them. At the moment its a black box, so it's pretty hard for me to make a decision as to what to do with them. But my inclinations are:

3. If we can't convict them of something in a public court, I'd probably let them go.

I don't believe him that the Iranian government are actively supporting Iraqi insurgent groups trying to kill Americans.

Yeah, its probably true, I just don't take my government's word for it. And its also another sign of glaring incompetence. I'm amazed that the US immediately after the invasion didn't put marines at every border crossing with Iran that has a road. If the Iranians are going to haul munitions into Iraq over desert passages using camels at midnight, fine. But if truckloads of Iranian munitions are just let into Iraq via a freeway, its a sign of incredible incompetence, IMO.
