Responsibility for actions flows from the reason the actions were taken. For example, exigency often frees people of liability for actions that in calmer times would make them liable. Fear of a threat a reasonable person would respond to, frees you from liability when you act on that fear. These things are inextricably linked, to me. You can discuss them in isolation if you want to, but I don't think that's the right way to tackle the issue. That's what these boards are for, right? Different people seeing problems in different ways.
