I don't think so. And I don't think cps agencies consider a severe alcoholic safe for kids. Unless they show they've gotten help to control the problem - attending aa and so forth.

I don't know enough about current practice to extrapolate it out to determine how it would deal with drug legalization, except to say that someone having obvious severe problems from legal or illegal drug use might not be a good candidate to be considered someone who provides a safe place for children.

Okay I'm thinking you would be okay with govt agencies forbidding the use of legal drugs if there is a belief that it might be bad for kids placed in the home. Good.
