but sometimes it's worth it to set a past practice. if the job description has the duties written down and they were reviewed with the person before hiring and he or she knew that was the condition of employment. you do not have a case.

oh, does the loser have to pay court costs if they lose? Can target etc turn around and sue for damages.?

besides if yor are the store manager you could care less about if they sue.. it's not your problem.. you are responsible to run the store. office of general counsel it reponsible to represent the company.

I would have fired the person!
