Since Cheney had nothing to do with the trial it's rather moronic to think he would be subpoenaed on an appeal of the trial. I just chalked it off to BDS however.

If you look at typical appeal timelines, the appeal would be heard in the Aug-Oct 2008 timeframe - just before the election. What Republican wants to put Libby back on page 1 just before the election - bad politics. The appeal process would have to find a technical error in either the court or the prosecution to justify overturning the current verdict. Fitzgerald is no dummy and he will make the administration squirm if necessary to keep his victory - that means calling people to testify under oath about what really happened in the vice president's office. If technical problems are found in the first trial, Fitzgerald will up the ante by calling Cheney to the stand. He didn't need to do that at Libby's first trial to get a victory, so why take the chance then?

Wait and see - no appeal because Libby will be pardoned on June 6th if no retrial.
