In the unlikely event no work-around is possible, it can import blank chips and program them here, avoiding any possible exclusion, an exclusion which isn't likely to happen in the first place.

The above is wrong because even if the blank chip is programmed in the US, it is doubtful that the handset or card would be manufactured here. Instead, the programmed chip would probably be exported for incorporation into a handset manufactured in Taiwan, China or wherever, then the handset with the chip in place would be imported into the US. The ITC under certain circumstances could order downstream remedies and exclude the entire handset.

Plus, it makes no economic sense to import the chip into the US for programming, then exporting it again so somebody can make a handset with it that will be imported into the US.

I apologize for the error.

Of course, a work around would solve the problem.
