What she testified to is that she wasn't sure if she met all the legal criteria. Not being a lawyer, she probably never investigated the issue in depth. I dunno about you, but if my employer told me I was covert, I'd assume I was. I wouldn't go and look up the legal definition of a particular law and decide whether or not all the points applied to me. You might be different.
