Getting back to the actual case rather then hypothetical, apparently there was no prosecution, but if there was its far from clear that it would have been an unjust malicious prosecution. It may have been a fully justified prosecution. More likely it was a borderline case.

There was no prosecution because the state attorney acted with integrity...but the attempt to pressure a prosecution is not immaterial. That is the reason the investigation is under way. This is serious stuff...stuff that undermines democratic processes.
