by the same right, if NOK is infringing the GSM patents in EU, then they should get closed down on GSM, thus taking away the fallback roaming mode that EVERY WCDMA chipset has in EU.

If the ITC does BRCM claims, then they would HAVE to do NOK. This would close down Cingular, since Cingular has almost all GSM roaming everywhere for coverage.
